GENERAL TERMS AND CONDITIONS FOR VEHICLE RESERVATION, RENTAL AND USE

INTRODUCTION

These General Terms and Conditions ("Terms and Conditions") govern the reservation, rental and use of vehicles provided by Life Cars.

By making a reservation, signing the Rental Agreement, taking possession of the vehicle or using any services provided by Life Cars, the Customer confirms that they have read, understood and accepted these Terms and Conditions without reservation.

These Terms and Conditions form an integral part of every Rental Agreement concluded between Life Cars and the Renter and shall apply throughout the entire rental period.

Any matters not expressly regulated herein shall be governed by the applicable legislation.

CHAPTER I

GENERAL PROVISIONS

Article 1

Definitions

For the purposes of these Terms and Conditions, the following definitions shall apply:

Life Cars (Lessor) – the vehicle rental company providing vehicles and related services.

Renter – the individual or legal entity entering into the Rental Agreement with Life Cars.

Authorised Driver – any person approved by Life Cars and authorised to drive the rented vehicle.

Rental Agreement – the agreement concluded between Life Cars and the Renter governing the rental of the vehicle.

Vehicle – any motor vehicle supplied by Life Cars under the Rental Agreement.

Security Deposit – the refundable amount collected as financial security for the Renter's contractual obligations.

Protection Package – the optional package selected by the Renter to reduce financial liability, subject to these Terms and Conditions.

Rental Period – the period commencing when the vehicle is handed over to the Renter and ending when it is returned to and accepted by Life Cars.

Article 2

Scope of Application

These Terms and Conditions apply to:

all reservations made through the Life Cars website;reservations made by telephone, e-mail or in person;all Rental Agreements concluded with Life Cars;all vehicles rented by Life Cars;all additional services offered by Life Cars.In the event of any conflict between these Terms and Conditions and the Rental Agreement, the provisions of the Rental Agreement shall prevail only where expressly agreed in writing.

Article 3

Eligibility Requirements

A vehicle may only be rented by a person who:

satisfies the minimum age requirements established by Life Cars;holds a valid driving licence recognised under the applicable legislation;presents a valid passport or national identity card;provides a valid payment method accepted by Life Cars;fulfils all additional requirements applicable to the selected vehicle category.Life Cars reserves the right to refuse any rental request if the required conditions are not met.

Article 4

Reservations

A reservation becomes valid only after confirmation by Life Cars.

Life Cars reserves the right to refuse or cancel any reservation where:

the requested vehicle is unavailable;incorrect or incomplete information has been provided;payment or pre-authorisation cannot be completed;fraud or misuse is reasonably suspected;or any other justified reason exists.Vehicle availability is not guaranteed until the reservation has been confirmed by Life Cars.

Article 5

Rental Agreement

The Rental Agreement becomes legally binding upon signature by both parties or upon any other legally recognised form of electronic acceptance.

The Rental Agreement incorporates these General Terms and Conditions by reference.

By signing the Rental Agreement, the Renter confirms acceptance of all rights and obligations contained herein.

Article 6

Vehicle Categories

Reservations are made for a vehicle category and not for a specific make, model, engine type, colour or specification, unless expressly confirmed in writing by Life Cars.

Where the reserved vehicle becomes unavailable due to unforeseen circumstances, Life Cars may provide an equivalent or higher-category vehicle without additional charge, subject to availability.

Article 7

Rental Charges

The rental price shall be determined in accordance with the applicable price list or the confirmed reservation.

The rental charge may include:

the basic rental fee; applicable taxes; the selected Protection Package; additional equipment; optional services; and any other agreed charges.Any additional costs arising during the rental period shall be charged separately in accordance with these Terms and Conditions.

Article 8

Security Deposit

Life Cars may require the Renter to provide a Security Deposit before the vehicle is released.

The amount of the Security Deposit depends on:

the vehicle category; the selected Protection Package; the rental duration; and any other risk factors considered relevant by Life Cars.The Security Deposit does not limit the Renter's liability where the actual damage exceeds the deposited amount.

Article 9

Payment

Rental charges may be paid using payment methods accepted by Life Cars.

The Renter authorises Life Cars to charge any outstanding contractual obligations, including rental charges, damages, penalties, administrative fees and other amounts payable under the Rental Agreement.

Article 10

Rental Period

The rental period begins when the vehicle is delivered to the Renter and ends only when the vehicle has been returned, inspected and formally accepted by Life Cars.

Any extension of the rental period must receive prior approval from Life Cars.

Failure to return the vehicle within the agreed rental period without prior authorisation constitutes unauthorised use and entitles Life Cars to exercise all contractual and legal remedies available under applicable law.

Article 11

Vehicle Collection

The vehicle shall be handed over only after:

the Rental Agreement has been concluded;the required identification documents have been verified;payment has been completed or authorised;the Security Deposit, where applicable, has been secured;and all rental requirements have been fulfilled.The Renter shall inspect the vehicle upon collection and immediately report any visible damage or discrepancies.

Failure to report any visible damage at the time of collection shall constitute acceptance of the vehicle in the condition recorded by Life Cars.

Article 12

Vehicle Handover

The vehicle shall be delivered in a roadworthy, clean and safe condition together with all standard equipment and documentation.

The handover may be documented by means of:

a Vehicle Handover Report; photographs; video recordings; electronic inspection reports; or any other form of digital documentation used by Life Cars.By signing the Vehicle Handover Report or the Rental Agreement, the Renter acknowledges that the vehicle has been received in the recorded condition.

Article 13

Vehicle Condition

Life Cars confirms that every vehicle is inspected before delivery and is suitable for normal road use.

Should a mechanical fault occur during the rental period that is not caused by misuse or negligence on the part of the Renter, Life Cars shall take reasonable steps to repair the vehicle or provide a replacement vehicle, subject to availability.

Life Cars does not guarantee the availability of an identical make or model.

Article 14

Equipment Supplied with the Vehicle

Depending on the vehicle category, the following items may be supplied with the vehicle:

vehicle keys; registration documents; safety triangle; reflective safety vest; first aid kit; spare wheel or tyre repair kit; vehicle tools; charging cable where applicable; and any optional equipment reserved by the Renter.The Renter is fully responsible for all equipment supplied until the vehicle is returned.

Article 15

Permitted Use

The vehicle shall be used with the level of care expected from a prudent and responsible owner.

The Renter shall use the vehicle only for its intended purpose and strictly in accordance with the manufacturer's recommendations and all applicable laws.

The Renter shall be liable for any damage resulting from improper, careless or unauthorised use of the vehicle.

Article 16

Renter's Obligations

Throughout the rental period, the Renter shall:

comply with all applicable traffic laws and regulations;regularly monitor the vehicle's warning indicators;immediately stop driving if a critical warning light appears;promptly inform Life Cars of any malfunction or damage;avoid continued use of the vehicle where further damage may occur;properly secure and lock the vehicle whenever unattended;never leave the keys or vehicle documents inside the vehicle;take all reasonable precautions to protect the vehicle against theft, loss or damage.Article 17

Prohibited Use

The vehicle shall not be used:

for motor racing or speed testing;for drifting or motorsport activities; for driver training; for carrying passengers or goods for hire or reward without prior written authorisation;for transporting hazardous, flammable or explosive materials;for transporting construction materials capable of damaging the vehicle;off-road or on unsuitable terrain; through flooded areas; for towing unless expressly authorised by Life Cars;or for any unlawful purpose.Any breach of this Article shall constitute a material breach of the Rental Agreement.

Article 18

Alcohol, Drugs and Impairment

The vehicle must never be driven by a person who is:

under the influence of alcohol;under the influence of illegal drugs;under the influence of narcotic substances;or impaired by medication affecting the ability to drive safely.Where any of the above circumstances apply:

all Protection Packages shall immediately become void;the Renter shall bear full financial responsibility for all resulting losses and damages;and Life Cars may terminate the Rental Agreement with immediate effect.Article 19

Cross-Border Travel

The vehicle may only be taken outside the country with the prior written approval of Life Cars.

Permission may be refused for certain vehicle categories, destinations or operational reasons.

If the Renter takes the vehicle abroad without written authorisation:

insurance and Protection Package benefits may become invalid;the Renter shall assume full liability for all losses and damages;Life Cars may immediately terminate the Rental Agreement and require the immediate return of the vehicle.The Renter remains responsible for complying with all laws and regulations applicable in every country where the vehicle is used.

Article 20

Mileage

Where the Rental Agreement includes a mileage limit, the Renter shall not exceed the agreed allowance.

Any excess mileage shall be charged in accordance with the applicable Life Cars Price List.

Where unlimited mileage is included, it shall not permit commercial use, continuous excessive operation, motorsport activities or any use beyond the normal purpose of a privately rented vehicle.

Article 21

Vehicle Handover

The vehicle shall be delivered in a clean, roadworthy and safe condition together with all standard equipment and required documentation.

Prior to delivery, Life Cars and the Renter shall jointly inspect the condition of the vehicle.

The vehicle condition may be recorded by means of:

a Vehicle Handover Report (Check-Out Report); photographs; video recordings; or any other electronic inspection method.By signing the Vehicle Handover Report or the Rental Agreement, the Renter confirms that:

the vehicle has been received in good condition;no damage exists other than that recorded in the inspection report;all keys, documents and equipment have been received.Article 22

Mechanical Condition of the Vehicle

Life Cars confirms that the vehicle has been inspected prior to delivery and is suitable for normal road use.

Should a mechanical defect arise during the rental period that is not attributable to the Renter's misuse or negligence, Life Cars shall take reasonable steps to repair the vehicle or provide a replacement vehicle, subject to operational availability.

Life Cars does not guarantee the provision of an identical make or model.

Article 23

Equipment Provided with the Vehicle

The vehicle may be supplied with:

vehicle keys; registration documents; warning triangle; reflective safety vest; first aid kit; spare wheel or tyre repair kit;charging cables or other standard accessories;additional equipment reserved by the Renter.The Renter shall remain fully responsible for all equipment supplied with the vehicle until it is returned to Life Cars.

Article 24

Proper Use of the Vehicle

The Renter shall operate the vehicle with the level of care expected from a prudent and responsible owner.

The vehicle shall only be used for its intended purpose and in accordance with the manufacturer's instructions.

The Renter shall be liable for any improper use resulting in damage to the vehicle or a reduction in its value.

Article 25

Responsibilities of the Renter

Throughout the rental period, the Renter shall:

comply with all applicable traffic laws and regulations;regularly monitor the vehicle's warning indicators;immediately stop driving if a critical warning light appears;promptly notify Life Cars of any mechanical defect or technical issue;refrain from continuing to drive where additional damage may occur;ensure that the vehicle is securely locked whenever unattended;never leave the keys or vehicle documents inside the vehicle;take all reasonable precautions to protect the vehicle against theft, loss or damage.Article 26

Prohibited Use

The vehicle shall not be used:

for motor racing; for speed testing; for drifting or motorsport activities;for driver instruction or training;for carrying passengers or goods for hire or reward without the prior written consent of Life Cars; for transporting hazardous materials; for transporting construction materials such as cement, plaster, paint, solvents or any substance capable of damaging or contaminating the vehicle;for transporting flammable or explosive materials;off paved roads or on unsuitable terrain;through flooded or otherwise unsafe areas;for any unlawful or criminal purpose.Any breach of this Article shall constitute a material breach of the Rental Agreement.

Article 27

Alcohol, Drugs and Impairment

The vehicle must not be driven by any person who is:

under the influence of alcohol;under the influence of illegal drugs;under the influence of narcotic substances;under the influence of medication that may impair the ability to drive safely.Where any of the above circumstances apply:

all Protection Packages shall immediately become void;the Renter shall bear full financial responsibility for all resulting losses and damages;Life Cars shall be entitled to terminate the Rental Agreement with immediate effect.Article 28

Cross-Border Use

The vehicle may only be taken outside the country with the prior written approval of Life Cars.

Permission may be refused for specific vehicle categories or destinations for operational or security reasons.

Where the Renter crosses the national border without written authorisation:

insurance cover may become invalid;all Protection Package benefits may cease to apply;the Renter shall bear full responsibility for all losses and damages;Life Cars may immediately terminate the Rental Agreement and require the immediate return of the vehicle.The Renter shall comply with all laws and regulations applicable in every country in which the vehicle is used.

Article 29

Mileage

Where the Rental Agreement specifies a mileage allowance, the Renter shall not exceed the agreed limit.

Any excess mileage shall be charged in accordance with the applicable Life Cars Price List.

Where unlimited mileage is included, it shall not authorise commercial use, participation in motorsport events, vehicle testing or any continuous operation exceeding the normal use of a privately rented vehicle.

Article 30

Subletting and Transfer of Possession

The Renter shall not:

sub-rent or lease the vehicle to any third party;allow any unauthorised person to use or possess the vehicle;use the vehicle as security or collateral;transfer, assign or otherwise dispose of any rights relating to the vehicle.Any such act shall constitute a material breach of the Rental Agreement and shall entitle Life Cars to terminate the Agreement immediately and pursue any remedies available under applicable law.

Article 31

Extension of the Rental Period

Should the Renter wish to extend the Rental Period, Life Cars must be notified no later than 24 (twenty-four) hours before the agreed return date and time.

Any extension shall only become effective after it has been expressly confirmed by Life Cars in writing or by electronic communication.

Continued use of the vehicle without prior approval from Life Cars shall constitute unauthorised possession of the vehicle and shall entitle Life Cars to exercise all contractual and legal remedies available.

Article 32

Return of the Vehicle

The Renter shall return the vehicle:

on the agreed date and time specified in the Rental Agreement;to the agreed return location;together with all keys, documents and accessories;with the agreed fuel level;in a clean, roadworthy condition, allowing for fair wear and tear.Where the vehicle is returned late without prior authorisation, Life Cars reserves the right to charge:

additional rental charges; late return fees; and any other applicable charges in accordance with the current Price List.Article 33

Post-Return Inspection

The physical return of the vehicle shall not automatically release the Renter from liability.

Life Cars reserves the right to carry out a detailed technical and visual inspection after the vehicle has been returned.

Such inspection may include:

professional vehicle washing; interior cleaning; electronic diagnostics; mechanical inspection; underbody inspection; verification of accessories and equipment.Should any damage, contamination or missing equipment relating to the Rental Period be identified during this inspection, the Renter shall remain fully liable for all resulting costs.

Photographs, video recordings, inspection reports and technical documentation prepared by Life Cars may be used as evidence of the vehicle's condition.

Article 34

Insurance

All vehicles operated by Life Cars are insured in accordance with the applicable laws and regulations.

In addition to the standard motor insurance, Life Cars offers optional Protection Packages designed to reduce the Renter's financial liability in the event of vehicle damage, subject to these Terms and Conditions.

No Protection Package shall relieve the Renter from the obligation to use the vehicle responsibly and in accordance with these Terms and Conditions.

No Protection Package constitutes comprehensive "All Risk" insurance or provides unlimited protection against every type of loss or damage.

Article 35

Protection Packages

Life Cars offers the following Protection Packages:

35.1 Basic Protection

Basic Protection is included in the standard rental price.

The Renter's maximum financial liability for vehicle damage shall be limited to €1,500, subject to these Terms and Conditions.

The amount of the Security Deposit shall depend on the vehicle category.

35.2 Medium Protection

Fee:

€10 per rental day

The Renter's maximum financial liability shall be reduced to €700.

A €200 Security Deposit shall apply.

35.3 Premium Protection

Fee:

€20 per rental day

The Renter's maximum financial liability shall be limited to €200.

No Security Deposit is required.

Article 36

Protection Package Coverage

The Basic Protection, Medium Protection and Premium Protection packages cover only external vehicle damage resulting directly from:

road traffic accidents; collisions with another vehicle; collisions with fixed objects; parking damage; acts of vandalism, where properly documented;other incidents accepted by the insurance provider.Coverage shall only apply where the Renter has complied with all contractual obligations and procedures set out in these Terms and Conditions.

Article 37

Exclusions from Protection

Regardless of the Protection Package selected, the following shall NOT be covered:

interior damage; interior contamination; professional or chemical cleaning; burns caused by cigarettes or electronic cigarettes; damage to seats; upholstery damage; steering wheel damage; gear selector damage; multimedia display damage; dashboard damage; interior trim damage; luggage compartment damage; roof lining damage; floor covering damage; tyres; wheels and alloy rims; underbody damage; loss or damage to vehicle keys; loss of vehicle documents; loss of registration plates; fuel shortages; misfuelling; mechanical damage resulting from misuse; intentional damage; damage caused by gross negligence.The Renter shall remain fully liable for all such losses.

Article 38

Circumstances Invalidating Protection

All Protection Packages shall become immediately invalid where it is established that:

the vehicle was driven by an unauthorised driver;the driver was under the influence of alcohol;the driver was under the influence of illegal drugs or narcotic substances;the vehicle was used for unlawful activities;the vehicle was used for racing or speed testing;the vehicle was taken abroad without the prior written authorisation of Life Cars;false or misleading information was provided;the driver left the scene of an accident unlawfully;Life Cars was not notified without undue delay;the competent authorities were not informed where legally required;a police report was not obtained where required;repairs were carried out without the prior written approval of Life Cars;the vehicle continued to be driven after a critical warning light had appeared, resulting in additional damage.In all such cases, the Renter shall remain fully liable for all resulting losses, damages and expenses.

Article 39

Obligations Following an Accident

In the event of an accident, collision, theft, attempted theft, vandalism or any other incident involving the vehicle, the Renter shall:

stop the vehicle immediately in a safe location;take reasonable steps to prevent further damage;notify Life Cars without delay;contact the police or any other competent authority where legally required;obtain all necessary official reports and documentation;refrain from admitting liability on behalf of Life Cars without prior authorisation;fully cooperate with Life Cars and its insurance provider throughout the claims process.Failure to comply with these obligations may invalidate the Protection Package and insurance benefits.

Article 40

Unsafe Vehicle

Where the vehicle is no longer safe to operate following an accident or damage, the Renter shall immediately cease using the vehicle and follow the instructions provided by Life Cars.

The Renter shall not continue driving where doing so could cause additional damage or endanger the safety of any person.

Any additional damage resulting from continued use of the vehicle contrary to this Article shall be the sole financial responsibility of the Renter.

Article 41

Cooperation with the Insurance Company

The Renter shall fully cooperate with Life Cars and, where applicable, the insurance provider throughout the claims handling process.

The Renter shall provide accurate, complete and truthful information together with all documentation requested by Life Cars or the insurance provider within the required time limits.

Failure to cooperate, or the provision of false, misleading or incomplete information, may result in the loss of insurance and Protection Package benefits, and the Renter shall remain fully liable for all resulting losses.

Article 42

Damage Assessment

Life Cars reserves the right to determine the extent of any damage through:

an authorised repair centre; an independent technical expert; the insurance provider; or any qualified specialist appointed by Life Cars.The assessment may be based on:

photographs; video recordings; inspection reports; technical reports; electronic diagnostic reports; repair estimates; invoices issued by authorised repair facilities.Such documentation shall constitute sufficient evidence of the damage and the related repair costs.

Article 43

Vehicle Repairs

Life Cars shall have the exclusive right to determine how the vehicle will be repaired.

Repairs shall be carried out only by:

an authorised manufacturer-approved repair centre; ora repair facility appointed by Life Cars.The Renter shall not arrange, authorise or carry out any repair without the prior written consent of Life Cars.

Where a damaged component cannot be restored to the manufacturer's quality standards, Life Cars may replace it with a new genuine part or an equivalent component of the same quality.

Article 44

Repair Costs

Where the vehicle is damaged, the Renter shall be responsible for all costs not covered by insurance or the applicable Protection Package.

Such costs may include:

replacement parts; repair materials; labour charges; electronic diagnostics; software programming and coding; towing and transportation; technical inspections; administrative expenses; and any other reasonable costs required to restore the vehicle to its pre-loss condition.Article 45

Hidden Damage

Life Cars reserves the right to identify damage that was not reasonably visible at the time the vehicle was returned.

Such damage may become apparent during:

professional vehicle washing; chemical cleaning; mechanical inspection; electronic diagnostics; dismantling of vehicle components; or service inspection.

Where hidden damage is documented and can reasonably be linked to the Rental Period, the Renter shall remain fully responsible for all associated costs.

Article 46

Inspection Following Professional Cleaning

Life Cars may carry out professional cleaning after the vehicle has been returned.

If professional cleaning reveals:

scratches; paint damage; dents; cracks; stains; interior damage; or any other defect concealed by dirt or contamination,such findings shall form part of the final vehicle inspection.

The Renter acknowledges that the final assessment of the vehicle's condition may only be completed after professional cleaning and a detailed inspection have been carried out.

Article 47

Loss of Use

Where damage caused by the Renter prevents the vehicle from being rented during the repair period, Life Cars shall be entitled, where permitted by applicable law, to recover compensation for Loss of Use.

Such compensation may take into account:

the repair period; parts availability; inspection and testing time; and the period during which the vehicle could not be rented.Loss of Use shall be recoverable independently of the repair costs.

Article 48

Diminution in Vehicle Value

Where the market value of the vehicle is reduced as a result of an accident or other damage occurring during the Rental Period, Life Cars reserves the right, where permitted by applicable law, to recover compensation for such diminution in value.

This right shall apply even where the vehicle has been fully repaired.

Article 49

Photographs, Video Recordings and Documentation

Life Cars may photograph and record the vehicle:

before delivery; during the Rental Period where necessary; upon return; during inspection; after professional cleaning; and throughout the repair process.Photographs, video recordings, inspection reports, technical reports and electronic records may be relied upon as evidence of the vehicle's condition and of the parties' respective responsibilities.

Article 50

Vehicles Equipped with Electronic Systems

Certain Life Cars vehicles may be equipped with electronic safety systems, telematics devices or GPS tracking equipment.

The Renter shall not:

disable any electronic safety system;disconnect or interfere with any electronic equipment;alter the vehicle's electrical installation;remove, tamper with or damage any GPS device or other monitoring equipment.Any unauthorised interference shall constitute a material breach of the Rental Agreement, and the Renter shall be fully liable for all resulting costs, losses and damages.

Article 51

Vehicle Recovery Costs

Where the vehicle requires recovery or transportation as a result of:

a road traffic accident; improper use; misfuelling; loss of vehicle keys; battery discharge caused by the Renter; vehicle lockout; or any other circumstance attributable to the Renter,the Renter shall be responsible for all associated costs, including:

towing services; vehicle transportation; roadside assistance; diagnostic inspections; and any other reasonable expenses incurred by Life Cars.Article 52

Misfuelling

If the Renter fills the vehicle with the incorrect type of fuel, the Renter shall be fully responsible for all resulting costs, including but not limited to:

vehicle recovery; draining and cleaning of the fuel system;repair or replacement of damaged components; electronic diagnostics; technical testing; and all other related expenses.Damage caused by misfuelling is not covered by any Protection Package or insurance policy.

Article 53

Battery Discharge

Where the vehicle battery becomes discharged due to improper use, including but not limited to:

leaving the lights switched on;operating electrical equipment with the engine switched off;failing to secure or switch off the vehicle correctly;or any similar negligent act,the Renter shall bear all costs relating to roadside assistance, battery replacement where necessary, transportation and restoration of the vehicle to operational condition.

Article 54

Financial Liability of the Renter

In all circumstances where damage, losses or expenses are not covered by insurance or exceed the applicable liability limits, the Renter shall be liable for the full amount of the actual loss suffered by Life Cars.

Life Cars shall be entitled to recover such amounts from the Security Deposit and, where the deposit is insufficient, to recover the remaining balance through any lawful means available.

Article 55

Duty of Care

Throughout the Rental Period, the Renter shall exercise reasonable care in the use of the vehicle and maintain it in a clean, safe and roadworthy condition.

The vehicle shall be used in a manner that prevents unnecessary mechanical, cosmetic or functional damage and preserves its market value.

Normal wear and tear resulting from proper use shall not constitute damage.

Article 56

Vehicle Cleanliness

The vehicle shall be returned in a clean condition.

Where the vehicle is returned in an excessively dirty condition requiring professional cleaning beyond normal vehicle preparation, Life Cars reserves the right to charge the Renter the full cost of such cleaning.

Excessive contamination shall include any condition exceeding ordinary use during the Rental Period.

Article 57

Chemical Cleaning

Where the vehicle requires professional Chemical Cleaning, deep cleaning, sanitisation or any specialised treatment in order to restore it to its original condition, the Renter shall bear all associated costs.

This may include contamination caused by:

mud; sand; oil or grease; food residue; beverages; coffee; wine; chocolate; ice cream; paint; chemical substances; blood; vomit; strong odours; tobacco smoke; animal hair; or any other contamination that cannot be removed through standard cleaning procedures.Where Chemical Cleaning alone is insufficient, the Renter shall also be responsible for the cost of replacing any permanently damaged components.

Article 58

Interior Damage

The Renter shall be liable for any damage to the interior of the vehicle.

This includes, but is not limited to:

seats; upholstery; steering wheel; gear selector; multimedia display; dashboard; electronic controls; door panels; armrests; headlining; flooring; luggage compartment; plastic trim; decorative panels; interior lighting; USB ports and electronic equipment.Where any component is scratched, cracked, torn, burned, deformed or otherwise damaged, Life Cars may repair or replace the affected component with a new genuine or equivalent-quality part in accordance with the manufacturer's standards.

All associated costs shall be borne by the Renter.

Life Cars shall not be required to accept cosmetic repairs that fail to restore the vehicle to its original condition.

Article 59

Damage Caused by Footwear

The Renter shall be responsible for any marks, scratches, stains or other damage caused by footwear or similar objects affecting:

seats; seat backs; door panels; door sills; vehicle flooring; luggage compartment; plastic trim; or any other interior component.Where the damage cannot be professionally repaired, the affected part shall be replaced, and all associated costs shall be borne by the Renter.

Article 60

No Smoking Policy

Smoking is strictly prohibited in all Life Cars vehicles.

This prohibition applies to:

cigarettes; electronic cigarettes; vaping devices; heated tobacco products; and any other product producing smoke, vapour or persistent odours.Any breach of this Article shall result in:

a minimum cleaning charge of €200; andpayment of all costs relating to Chemical Cleaning, sanitisation, odour removal and any necessary repairs.Where the vehicle cannot be rented due to persistent smoke odours, Life Cars shall also be entitled, where permitted by applicable law, to recover compensation for Loss of Use.

Article 61

Transportation of Animals

The transportation of animals in Life Cars vehicles is prohibited unless prior written approval has been obtained from Life Cars.

Where animals are transported without authorisation, the Renter shall be liable for any resulting:

contamination; animal hair; unpleasant odours; scratches; tears; damage to seats; upholstery damage; damage to the luggage compartment;or any other damage caused to the vehicle.Life Cars reserves the right to carry out Chemical Cleaning, sanitisation or replacement of damaged components, and all associated costs shall be borne by the Renter.

Article 62

Unpleasant Odours

The Renter shall be responsible for any odour created during the Rental Period that renders the vehicle unsuitable for subsequent rental.

This includes, but is not limited to, odours resulting from:

tobacco products; animals; food; alcoholic beverages; chemical substances; excessive use of perfumes or fragrances;or any other persistent unpleasant odour.Life Cars may carry out professional odour removal treatment, and all associated costs shall be charged to the Renter.

Article 63

Loss or Damage to Keys and Vehicle Documents

The Renter shall be fully responsible for the loss of or damage to:

vehicle keys; Smart Keys; remote control devices; vehicle registration documents; registration plates; additional equipment; or any other item supplied with the vehicle.The Renter shall reimburse Life Cars for all costs relating to:

replacement; programming; electronic coding; transportation; registration procedures; and any other related expenses.Article 64

Personal Belongings

Life Cars accepts no responsibility for the loss, theft or damage of personal belongings left inside the vehicle.

The Renter is responsible for ensuring that all personal belongings are removed before returning the vehicle.

Where personal property is found, Life Cars may retain such items for a reasonable period but accepts no liability for their loss, damage or failure to be collected.

Article 65

Traffic Fines and Road Charges

The Renter shall be solely responsible for all traffic offences and road-related charges incurred during the Rental Period.

This includes, without limitation:

speeding offences; parking violations; red-light offences; unlawful use of a mobile telephone while driving;failure to wear a seat belt; camera-enforced traffic violations; motorway tolls; tunnel charges; bridge tolls; parking fees; congestion or low-emission zone charges; and any other statutory or administrative charges arising from the use of the vehicle.The Renter shall remain liable for such charges even where they are issued after the Rental Period has ended.

Article 66

Administrative Fee

In addition to any traffic fine, penalty or statutory charge, Life Cars reserves the right to charge a reasonable administrative fee for handling matters including:

identification of the Renter; correspondence with public authorities; communication with insurance providers; preparation and processing of documentation; responding to official requests; and recovery of administrative costs.The administrative fee shall be payable separately and shall not replace the Renter's obligation to pay the original fine, charge or penalty.

Article 67

Mechanical Defects

Should a mechanical defect occur during the Rental Period, the Renter shall:

stop the vehicle immediately where continued operation could cause further damage;notify Life Cars without undue delay;follow all instructions provided by Life Cars.The Renter shall not continue driving where doing so could reasonably result in additional damage.

Where the damage results from misuse or failure to respond appropriately to vehicle warning indicators, the Renter shall bear all associated costs.

Article 68

Roadside Assistance

Where a breakdown or mechanical failure occurs, Life Cars shall arrange Roadside Assistance in accordance with the Rental Agreement or the selected service package.

Where Roadside Assistance becomes necessary as a result of:

misuse of the vehicle; misfuelling; loss of keys; battery discharge caused by negligence;locking the keys inside the vehicle;tyre damage caused by improper use;or any other circumstance for which the Renter is responsible,all Roadside Assistance and recovery costs shall be borne by the Renter.

Article 69

Tyre and Wheel Damage

The Renter shall be responsible for damage to tyres and wheels where such damage results from:

striking a kerb; impact with potholes; driving on unsuitable roads or terrain;negligent operation of the vehicle;or any other circumstance beyond normal wear and tear.Unless expressly stated otherwise in the Rental Agreement, tyre and wheel damage is not covered by any Protection Package.

Article 70

Misfuelling

Where the Renter fills the vehicle with an incorrect type of fuel, the Renter shall be liable for all resulting costs, including:

recovery and transportation of the vehicle;draining and cleaning of the fuel system; diagnostic testing; repair work; replacement of damaged components; technical inspections; and any other expenses reasonably incurred in restoring the vehicle to proper working condition.Damage resulting from misfuelling is expressly excluded from all Protection Packages and insurance cover.

Article 71

Battery Discharge

Where the vehicle battery becomes discharged as a result of improper use, including but not limited to:

leaving the lights switched on;operating electrical equipment while the engine is switched off;failing to secure the vehicle properly; using unauthorised electrical accessories;

the Renter shall be responsible for all costs associated with Roadside Assistance, vehicle recovery and restoring the vehicle to normal operating condition.

Article 72

Theft or Attempted Theft

In the event of theft or attempted theft of the vehicle, the Renter shall:

immediately notify the police; immediately inform Life Cars; surrender all vehicle keys in their possession;fully cooperate with the competent authorities and the insurance provider.Failure to comply with these obligations may invalidate the insurance and Protection Package cover and may result in the Renter being held fully liable for all resulting losses and damages.

Article 73

Vehicle Recovery

Where the vehicle must be recovered due to:

a road traffic accident; improper use; failure to return the vehicle on time;parking in an unauthorised location;seizure or immobilisation by public authorities;or any act or omission attributable to the Renter,Life Cars shall be entitled to arrange recovery of the vehicle.

The Renter shall bear all costs associated with vehicle recovery, transportation, storage, parking fees and any related expenses.

Article 74

Failure to Return the Vehicle

Where the vehicle is not returned on the agreed date and time, and no extension has been approved by Life Cars, the Company reserves the right to take all contractual and legal measures necessary to protect its property.

Life Cars may notify the competent authorities and initiate any legal proceedings necessary to recover possession of the vehicle, without prejudice to its right to recover all resulting losses, damages and expenses.

Article 75

Processing of Personal Data

Life Cars processes personal data in accordance with applicable data protection legislation.

Personal data may be processed for purposes including:

administration of reservations; performance of the Rental Agreement; compliance with legal obligations; debt collection; fraud prevention; protection of Life Cars' legitimate business interests;and protection of Life Cars' property.Article 76

Use of Personal Data

The Renter acknowledges and agrees that personal data may be processed solely for the purposes permitted under the Rental Agreement and applicable legislation.

Life Cars shall implement appropriate technical and organisational measures to protect personal data against unauthorised access, misuse, loss, disclosure or unlawful processing.

Article 77

Disclosure of Personal Data

Life Cars shall not disclose the Renter's personal data to third parties except where:

disclosure is required by law;it is necessary for the performance of the Rental Agreement;it is required for the handling of an insurance claim;it is necessary for debt recovery;or the Renter has given explicit consent.Article 78

Electronic Communication

The Renter agrees that communication between the parties may take place by electronic means, including:

e-mail; SMS messages; messaging applications; the online reservation platform; or any other electronic communication system used by Life Cars.Unless otherwise required by applicable law, electronic communications shall have the same legal validity and evidential value as written communications.

Article 79

Force Majeure

Life Cars shall not be liable for any delay or failure to perform its contractual obligations where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include, without limitation:

natural disasters; earthquakes; floods; fires; severe weather conditions; war; civil unrest; acts of terrorism; epidemics or pandemics; strikes; governmental actions or restrictions; border closures; or any other unforeseeable event beyond the reasonable control of Life Cars.In such circumstances, Life Cars shall not be liable for any indirect loss, consequential loss or economic damage suffered by the Renter.

Article 80

Limitation of Liability

To the fullest extent permitted by applicable law, Life Cars shall not be liable for:

loss of profit; loss, theft or damage to personal belongings; cancelled or delayed flights; cancelled hotel reservations; missed appointments, meetings or events;indirect, incidental or consequential losses;or any loss that is not the direct result of a breach of the Rental Agreement by Life Cars.Nothing in these Terms and Conditions shall exclude or limit any liability that cannot lawfully be excluded or limited under the applicable legislation.

Article 81

Dispute Resolution

Life Cars and the Renter shall use their best endeavours to resolve any dispute arising out of or in connection with the Rental Agreement or these Terms and Conditions through amicable negotiations.

Where an amicable settlement cannot be reached, the dispute shall be submitted to the competent court having jurisdiction in accordance with the applicable legislation.

Article 82

Governing Law

These General Terms and Conditions and the Rental Agreement shall be governed by and construed in accordance with the applicable laws.

Should any provision of these Terms and Conditions be held to be invalid, illegal or unenforceable, such provision shall be severed to the extent necessary, and the remaining provisions shall remain valid and fully enforceable.

Article 83

Electronic Acceptance and Signature

Acceptance of these General Terms and Conditions by means of an online reservation, electronic signature, electronic confirmation or any other legally recognised electronic method shall have the same legal force and effect as a handwritten signature.

The Renter acknowledges that electronic acceptance constitutes legally binding consent to all rights and obligations contained in these Terms and Conditions and the Rental Agreement.

Article 84

Code of Conduct

Life Cars encourages every Renter to use the vehicle responsibly and, throughout the Rental Period, to:

drive safely and responsibly at all times;comply with all applicable traffic laws and regulations;promptly report any accident, damage or mechanical defect;immediately stop driving if a critical warning indicator appears;keep the vehicle clean and well maintained;avoid causing damage to the interior or exterior of the vehicle; respect other road users; contribute to maintaining the quality, safety and reliability of the services provided by Life Cars.This Article is intended as guidance only and does not replace, limit or modify the contractual obligations set out elsewhere in these Terms and Conditions.

Article 85

Final Provisions

These General Terms and Conditions for Vehicle Reservation, Rental and Use constitute the entire agreement governing the relationship between Life Cars and the Renter, together with the Rental Agreement.

Any amendment, modification or waiver of these Terms and Conditions shall be valid only if made in writing and expressly approved by Life Cars.

The version published on the official Life Cars website shall constitute the official and governing version of these General Terms and Conditions.

By signing the Rental Agreement or confirming an online reservation, the Renter acknowledges and confirms that they have:

carefully read these General Terms and Conditions; fully understood their contents; accepted them without reservation; and agreed to comply with them throughout the entire Rental Period.LIFE CARS

ВОВЕД

Добредојдовте во Life Cars.

Овој документ ги утврдува Општите услови кои го регулираат договорниот однос помеѓу Life Cars (во понатамошниот текст: „Life Cars“, „Компанијата“ или „Давателот на наем“) и секое физичко или правно лице (во понатамошниот текст: „Клиент“ или „Закупец“) кое резервира или изнајмува возило.

Целта на овој документ е да обезбеди транспарентност, правна сигурност и заштита на интересите на двете договорни страни, преку јасно утврдување на нивните права, обврски и одговорности за време на резервирањето, преземањето, користењето и враќањето на возилото.

Со извршување на резервација, потпишување на Договорот за наем или со електронско прифаќање на овие Општи услови, Клиентот изјавува дека:

внимателно ги прочитал овие Општи услови; целосно ги разбрал; ги прифаќа без никакви резерви; се обврзува да ги почитува за целото времетраење на наемот.

Непрочитувањето или непознавањето на овие Општи услови не го ослободува Клиентот од обврската за нивно почитување.

ПОГЛАВЈЕ I

ОПШТИ ОДРЕДБИ

Член 1

Предмет

Овие Општи услови ги регулираат сите договорни односи помеѓу Life Cars и Клиентот кои се однесуваат на:

резервација на возила; краткорочен и долгорочен наем; користење на возилата; дополнителни услуги; плаќања; безбедносен депозит; осигурување; одговорност за штета; враќање на возилата; како и сите други услуги што ги обезбедува Life Cars.

Овие Општи услови претставуваат составен дел на секој Договор за наем и важат за сите резервации, без оглед на начинот на кој се извршени.

Член 2

Поле на примена

Овие Општи услови се применуваат на:

онлајн резервации; телефонски резервации; резервации преку е-пошта (e-mail); резервации во деловните простории на Life Cars; резервации преку овластени партнери или платформи; секој Договор за наем склучен со Life Cars.

Во случај на несогласување помеѓу Договорот за наем и овие Општи услови, ќе се применуваат одредбите од Договорот за наем само доколку истите се одобрени во писмена форма од страна на Life Cars.

Член 3

Дефиниции

За потребите на овој документ:

Life Cars – трговско друштво кое обезбедува услуги за резервација и изнајмување возила.

Клиент / Закупец – физичко или правно лице кое резервира или изнајмува возило.

Овластен возач – лице наведено во Договорот за наем и одобрено од Life Cars за управување со возилото.

Возило – секое возило изнајмено од Life Cars, заедно со клучевите, документацијата, стандардната опрема и дополнителната опрема.

Договор за наем – документ или електронски договор со кој се утврдуваат индивидуалните услови за изнајмување.

Безбедносен депозит – паричен износ обезбеден од Клиентот како гаранција за исполнување на обврските кои можат да произлезат за време на периодот на наем.

Период на наем – временски период кој започнува со преземањето на возилото и завршува со неговото враќање согласно Договорот за наем.

Член 4

Прифаќање на Општите услови

Клиентот прифаќа дека секоја резервација или потпишување на Договорот за наем претставува целосно прифаќање на овие Општи услови.

Прифаќањето може да се изврши:

со физички потпис; со електронски потпис; со потврда при онлајн резервација; или на кој било друг начин признат согласно важечките законски прописи.

Овие Општи услови имаат иста правна сила како и Договорот за наем.

Член 5

Право на измена

Life Cars го задржува правото во секое време да ги измени, дополни или ажурира овие Општи услови, согласно важечките законски прописи.

Верзијата објавена на официјалната интернет-страница на Life Cars се смета за официјална и важечка за сите резервации направени по датумот на нејзиното објавување.

Член 6

Начело на совесност и добра волја

Life Cars и Клиентот се обврзуваат да постапуваат совесно, чесно и во духот на добра волја во текот на целиот договорен однос.

Секоја измама, злоупотреба или постапување спротивно на целта на овој договор ќе се смета за сериозно прекршување на договорните обврски и му дава право на Life Cars веднаш да го раскине Договорот за наем, без да го изгуби правото да бара целосен надомест на причинетата штета.

Член 7

Документација и доказна вредност

Клиентот прифаќа дека документацијата подготвена од Life Cars, вклучувајќи:

Договор за наем; Записник за примопредавање и враќање на возилото; фотографии; видео записи; извештаи од инспекција; технички извештаи; комуникација преку е-пошта; електронска комуникација; записи од системот за резервации;

може да се користи како доказ при управување со договорниот однос и, доколку е потребно, во управни, судски или други законски постапки.

Член 8

GPS систем и управување со возниот парк

Заради безбедност, заштита на возилата, управување со возниот парк, пронаоѓање на возилото во случај на кражба, следење на неговата локација и обезбедување на услугите за изнајмување, дел или сите возила на Life Cars може да бидат опремени со GPS систем или други електронски уреди за локација.

Со потпишување на Договорот за наем или со потврдување на онлајн резервацијата, Закупецот потврдува дека е однапред информиран дека возилото може да биде опремено со GPS систем, дека разбира оти возилото може да биде лоцирано за време на целиот период на наем и дека го прифаќа тоа како составен дел од договорниот однос.

Податоците добиени преку GPS системот се користат исклучиво за:

заштита на возилото; управување со возниот парк; пронаоѓање на возилото во случај на кражба или незаконско присвојување; утврдување на локацијата во случај на сообраќајна незгода, итна состојба или прекршување на договорот; исполнување на законските обврски на Life Cars.

Life Cars ги обработува овие податоци во согласност со важечките прописи за заштита на личните податоци и нема да ги користи за други цели, освен во случаите предвидени со закон или со овие Општи услови.

Член 9

Делумна ништовност

Доколку некоја одредба од овие Општи услови биде прогласена за ништовна или неприменлива од надлежен орган, тоа нема да влијае врз важноста и применливоста на останатите одредби, кои остануваат целосно во сила.

Член 10

Неоткажување од права

Неискористувањето или задоцнетото користење на кое било право од страна на Life Cars нема да се смета за откажување од тоа право.

Секое право или правно средство предвидено со овие Општи услови може да биде искористено од страна на Life Cars во секое време, во согласност со важечките законски прописи.

Automjeti me qira mund të drejtohet nga çdo person:

·      Kush zotëronte një kartë identiteti/pasaportë të vlefshme plotësisht

·      që ka një patentë shoferi të vlefshme për të paktën 3 vjet

·      kush është 21 vjeç

 

 Drejtim i autorizuar

·      Automjeti me qira NUK do të drejtohet nga asnjë person tjetër përveç blerësi ose shoferi i autorizuar

·      i cili nuk është më i ri se 21 vjeç

·      që nuk ka një patentë shoferi plotësisht të vlefshme

 

 Automjeti i marrë me qira NUK do të përdoret për:

·      për transportin e pasagjerëve ose pronës me pagesë ose shpërblimза gara, testim shpejtësie, udhëzime drejtimi

·      për lëvizjen ose tërheqjen e çdo automjeti ose rimorkioje tjetër

·      nën ndikimin e alkoolit, drogave halucinogjene, narkotikëve ose barbiturateve

·      kundërshtim ndaj autostradave ose rrugëve të shërbyera nga qeveritë federale, shtetërore ose provincial

·      për çdo qëllim të paligjshëm

 

Marja dhe kthimi

·      Blerësi merr përsipër ta kthejë automjetin me të gjitha dokumentet e automjetit, çelësat, gomat, mjetet, pajisjet audio dhe aksesorët e tjerë në të njëjtën gjendje siç është marrë në vendin dhe në datën e specifikuar nga pala tjetër. Nëse vonoheni në kthim, Life Cars Ltd mund t'ju faturojë për një ditë të plotë.Доколку е потребно посебно чистење од која било причина, Лифе Царс ќе наплати посебна наплата за покривање на трошоците.

Zgjatja e qirasë

Në rast se Klienti kërkon një automjet për një periudhë më të gjatë se ajo e rënë dakord, Konsumatori duhet të njoftojë Life Cars të paktën 24 orë para përfundimit të periudhës së qirasë së rënë dakord.

 

Karburant

Automjetet dorëzohen me rezervuar të plotë karburanti. Blerësi është përgjegjës për kostot e karburantit që nga momenti që largohet nga dega e kompanisë deri në momentin që kthehet në degën e kompanisë. Blerësi duhet ta kthejë automjetin me rezervuar të plotë karburanti. Përndryshe, çmimi i karburantit do të ngarkohet në shumën prej 5 eurosh për litër.

Blerësi pranon se çdo pronë e vendosur në automjet është në rrezikun e tij. Life Cars nuk ka përgjegjësi për pronë të tillë.

 

·      DEPOZITË

Depozitë në para të gatshme ose e garantuar me kartë krediti për çdo automjet nga 1 deri në 500 € (në varësi të kategorisë së automjetit). Pasi automjeti të kthehet, nëse gjithçka është në rregull me automjetin, depozita do t'i kthehet klientit. Nëse ka ndonjë dëmtim në automjet të shkaktuar nga klienti, depozita do të përdoret për të mbuluar kostot e atij dëmi.

 

SIGURIM

·      Mbrojtje bazë e përfshirë

·      Heqje dorë nga përgjegjësia për dëme që tejkalojnë 1500 €

Konsideroni 200 €. Pranojmë karta debiti ose para në dorë.

 

·      Mbrojtje mesatare 5.- € / në ditë

·      Lirim nga përgjegjësia për dëmet që tejkalojnë 700 €

Kredi 200 € Pranojmë karta debiti ose para në dorë

 

·      Mbrojtje Premium 15.- € / në ditë

·      Lirim nga përgjegjësia për dëmet që tejkalojnë 200 €

Depozitë 0 € Ne pranojmë karta debiti ose para në dorë.

 

SHUMË E RËNDËSISHME!

·      Sigurimi i dëmeve nuk zbatohet në rastet e mëposhtme:

·       Makina drejtohet nën ndikimin e alkoolit ose drogës.

·      Në rast aksidenti ose dëmtimi, nuk paraqitet raport policie me kthimin e makinës për qëllime sigurimi.

·      Qiramarrësi i ka lejuar një personi tjetër që nuk është i autorizuar në Marrëveshje ose nuk ka patentë shoferi të drejtojë makinën.

·      Gomat e makinës janë të dëmtuara, jo si pasojë e një zjarri apo aksidenti me makinë

·      Qiramarrësi e ka dëmtuar qëllimisht makinën ose aksesorët e saj.

 

E RËNDËSISHME

·      Blerësi është përgjegjës për shkeljet e rregullave të trafikut, gjobat e parkimit (të bëra gjatë periudhës së qirasë), si dhe pas periudhës së qirasë së tij.

·      Klienti deklaron se na lejon vullnetarisht të kemi një kopje të pasaportës dhe patentës së tij/saj

 

·      SHUMË E RËNDËSISHME:

·      Pirja e duhanit dhe cigaret elektronike janë të ndaluara në të gjitha automjetet e Life Cars. Në të kundërt, gjoba do të jetë 200 euro.

·      Për çdo problem me automjetin, jeni të detyruar të na kontaktoni, nuk keni të drejtë ta dërgoni makinën në një qendër servisi për shkak të ndonjë problemi.

 

Nëse kontrata ndërpritet para kohe nga klienti, paratë nuk do të rimbursohen.
